BEFORE: ENGEL and KRUPANSKY, Circuit Judges; and HILLMAN, District Judge* Order Ray appeals from the district court's order dismissing his civil rights complaint.The district court held that Ray failed to state a claim. This appeal has been referred to a panel of the Court pursuant to Rule 9(n), Rules of the Sixth Circuit. After an examination of the record and the briefs, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Ray was convicted of the murder of Martin Luther King and is now serving his sentence. Ray requested a pardon. In Tennessee, the Board of Paroles recommends to the Governor whether an applicant is qualified for a pardon. Here the Board refused to hold a hearing and refused to recommend that Ray receive a pardon.
